These Terms of Service (this “Agreement”) are entered into by Ahead Web Services and the entity executing this Agreement (“You”). By using any part of our site or service, you acknowledge that you have reviewed and accept this agreement and are authorized to act on behalf of, and bind to this agreement, the owner of this account. The parties agree to the following:

“Account” refers to the account for the Service.

Confidential Information includes any data and any other information disclosed by one party to the other in writing and marked “confidential” or disclosed orally and reduced to writing and marked “confidential”.

Documentation means any accompanying documentation made available to You by our website for use, including any documentation available online.

Profile means the collection of settings that together determine the information to be included in, or excluded from, a particular Report.

Privacy Policy means the privacy policy on a account.

Unless otherwise stated, all fees and subscriptions are quoted in Australian Dollars and do not include GST. Residents of Australia are subject of GST charge. Any subscription amount becomes immediately due and payable upon at the time of start of the service. Termination of this Agreement and any collection expenses incurred by us will be included in the amount owed, and may be charged to the credit card or other billing mechanism associated with your account. We are not responsible for processing fee, foreign exchange charges or transactional charges made by your bank for the payment of fees or subscriptions. Late payment or non payment of fees or subscription charges may incur late payment charges. All fees and subscriptions are charged on a automatic, renewal or recurring basis by our payment provider until the subscription or services or fees are cancelled.

You can cancel your service or subscription at any stage should you wish to do so. Upon any termination of this Agreement, we will stop providing, and You will stop accessing the Service and subscription.  After cancellation of service, your account status may change to a “pending cancellation” stage for a grace period to allow to save or remove any data you may have with us. For security (to prevent hacks, attacks) or for safety of other clients we have the right to stop or cancel your subscription or account with us. In the event of any termination (a) You will not be entitled to any refunds of any usage fees or any other fees, and (b) any outstanding balance rendered through the date of termination will be immediately due and payable in full. Any leftover amount is not refunded after the cancellation of service.

The refund or money back policy only applies to products and services stated with “refund” or “money back” claims in description and does not apply to any other products or services. The “30 -day” refund policy comes only with a refund of the fees incurred for the service, provided the service or subscription is cancelled within the first 30 days of subscription commencing and does not include any extra bank or transactional charges. The refunds are processed manually provided the subscription is cancelled by the user within the first 30 days. The refund policy has a limit of refund of up to one subscription per account per card. Misuse of refund policy may result in cancellation of refund.

To use our services you must register for the Service, You must complete the registration process by providing us with current, complete and accurate information as prompted by the registration form, including Your e-mail address (username) and password.

You will protect Your passwords and take full responsibility for Your own, and third party, use of Your accounts. You are solely responsible for any and all activities that occur under Your Account. You will notify Google immediately upon learning of any unauthorized use of Your Account or any other breach of security. Google’s (or its wholly-owned subsidiaries) support staff may, from time to time, log in to the Service under Your customer password in order to maintain or improve service, including to provide You assistance with technical or billing issues.

If You use the Service or subscription on behalf of the Third Party or a Third Party otherwise uses the Service through Your Account, whether or not You are authorized by us to do so, then You represent and warrant that (a) You are authorized to act on behalf of, and bind to this Agreement, the Third Party to all obligations that You have under this Agreement.

If you are using or hosting services on behalf of a client or entity you must have the authorization from the owner to change the setting related to the domain for us to provide the service. These settings include the nameserver(s) location, dns hosting location(s) and the website hosting location(s), web server(s) location for the service to be able to be delivered and provided to the owner. The owner of the domain name or any person(s)/ entity authorized to act on behalf of client authorizes Ahead Web Services to make any required changes related to their domain name or domain registrar in order to deliver the web hosting, email service or any other web or cloud service or subscription to the client.

To the extent permitted by applicable law, except as expressly provided for in this agreement, Ahead Web Services makes no warranty(ies) of any kind, whether express, implied, statutory or otherwise, including without limitation warranties of merchantability, fitness for a particular use and non infringement.

To the extent permitted by the law, Ahead Web Services will not be liable for any lost revenues or indirect, special, incidental, consequential, exemplary or punitive damages, even if Ahead Web Services or its subsidiaries and affiliates have been advised of, knew or should have known that such damages were possible and even if direct damages do not satisfy a remedy. We are not responsible for any damages, expenses or liabilities resulting from claims, demands, actions arising out of or relating to this agreement.

To the best of our capability we try and maintain a outage free service and will not be responsible for any losses, liability or expenses of any form or kind should there be any outages to our services whether or not beyond our control.
